Subcontractor Requirements
To keep in compliance with Minnesota regulations and maintain the highest standards, prospective subcontractors must meet the following criteria:
Separate Business Operations: Maintain your own office, equipment, materials, and facilities.
Federal Employer Identification Number (FEIN): Possess or have applied for a FEIN, or have filed business or self-employment income tax returns with the IRS if services were performed in the previous year.
Contractual Agreements: Operate under a contract specifying services for set amounts, with control over the means of performing these services.
Expense Responsibility: Incur the main expenses related to your services under the contract.
Service Accountability: Be responsible for the satisfactory completion of contracted services and liable for any failure to complete them.
Compensation Structure: Receive payment on a commission, per-job, or competitive bid basis, not on any other basis.
Profit and Loss Potential: Have the potential to realize a profit or suffer a loss under the contract.
Ongoing Business Obligations: Maintain continuing or recurring business liabilities or obligations.
Business Success Dependence: Ensure your business's success or failure depends on the relationship between business receipts and expenditures.
